IAS MENTORSHIP 3 min read

Freedom of Speech: Article 19(1)(a) guarantees freedom of speech and expression to citizens.

  • Reasonable Restrictions: The right under Article 19(1)(a) is subject to restrictions under Article 19(2).
  • Parliamentary Freedom of Speech: Article 105(1) provides freedom of speech in Parliament, subject to the Constitution and rules/procedures regulating the proceedings.
  • Parliamentary Privileges: Article 105 deals with the powers, privileges and immunities of Parliament, its Members and committees.
  • Protection for Speech/Vote: Under Article 105(2), no Member of Parliament is liable to proceedings in any court for anything said or any vote given in Parliament or any committee thereof.
  • State Legislatures: Article 194 provides corresponding provisions relating to the powers, privileges and immunities of State Legislatures and their Members.
  • Key Difference: Article 19(1)(a) is a general fundamental right, whereas parliamentary freedom of speech and privilege are designed to ensure the independent functioning of legislatures.
  • Prelims Trap: Parliamentary privilege is not the same as the general freedom of speech under Article 19(1)(a).
  • Important: Article 105 → Parliament; Article 194 → State Legislature.
