· The IAEA primarily works through nuclear safeguards, verification, nuclear safety, nuclear security, technical cooperation and peaceful applications of nuclear technology.
· Its safeguards system uses technical measures to verify that states are honouring their international legal obligations and that nuclear material and technology are not diverted towards prohibited military purposes.
IAEA and NSG Connection
The NSG Guidelines are published through the IAEA’s INFCIRC series, although the IAEA does not control or administer the NSG.
NSG and India
· India’s Non-NPT Status: India is not a signatory to the NPT, and traditional NSG participation criteria have included adherence to the NPT or equivalent international non-proliferation arrangements. This has been one of the major obstacles to India’s full membership.
· 2008 NSG Waiver: A major breakthrough came in 2008, when the NSG adopted a specific policy statement permitting civil nuclear cooperation with India, taking into account India’s voluntary commitments, separation of its civilian and strategic nuclear facilities, its IAEA safeguards agreement and its commitment to adhere to NSG Guidelines. This waiver ended India’s long-standing isolation from international civilian nuclear commerce.
· India’s IAEA Safeguards Agreement: India concluded an agreement with the IAEA for the application of safeguards to its civilian nuclear facilities, which entered into force in 2009. India also brought an Additional Protocol into force in 2014.
· India’s Adherence to NSG Guidelines: India formally communicated in May 2016 that it would adhere to the NSG Guidelines and its national export-control system was harmonised with the relevant requirements. The NSG officially records India as a unilateral adherent to the Guidelines, but this does not confer Participating Government status.
· India’s Bid for Full NSG Membership: India applied for NSG membership in 2016. However, its application has not been accepted because the NSG operates by consensus and some participating governments have sought a broader criteria-based approach for considering the membership applications of non-NPT states.
